The State of AI - 2026-10-16
Grid rules, capital discipline and exploitable infrastructure are becoming the practical tests for AI expansion—while new models and agents push faster into local, enterprise and physical environments.

Executive summary
The defining issue in this edition is execution under constraints. Compute supply remains tight and large infrastructure projects continue to advance, but regulators, grid operators, lenders and security teams are increasingly demanding evidence that systems can be powered, governed, secured and financed—not merely announced. For executives, voluntary safety and sustainability claims are giving way to proposed operational duties, contractual controls and scrutiny of who bears the downside when deployments fail.
North American grid rules move closer to direct duties for qualifying computational loads
NERC’s proposed computational-load standards passed their final stakeholder ballot and now move to its board, followed by submission to FERC for regulatory approval. If adopted, the proposed rules would apply to computational-load sites meeting the specified connected-load and voltage criteria. They would require relevant owners and operators to provide grid-planning and operational data, coordinate protection settings and, subject to defined exceptions, comply with grid-operator instructions. The package remains proposed: neither the ballot result nor the FERC filing deadline makes the requirements immediately binding on data centers.
The key governance question is no longer whether an operator has a voluntary grid-responsibility program. It is whether a site falls within the eventual scope, who is registered as owner or operator, what information that party actually controls at multitenant facilities, and whether it can demonstrate instruction-handling, communications, model maintenance and protection coordination. Boards should treat this as an emerging compliance workstream, not as a generic sustainability commitment.

Power access is becoming conditional on credible financing, renewables and local legitimacy
Greece has proposed legislation that would require data centers to source a stated share of power from renewables, support grid-connection and reinforcement costs, and provide a per-megawatt bank guarantee for connection requests. The proposal is under consultation, not yet an operative obligation. In the UK, the government rejected a proposed AI Growth Zone project associated with Drax after local reporting said it did not meet criteria covering credible energy delivery, environmental considerations and local economic benefit. Separately, survey research reported broad local opposition to data-center construction and concern that local electricity bills could rise.
Developers need to distinguish a connection request, a corporate renewable-energy claim and a legally enforceable energy obligation. Project sponsors must be able to show financing readiness, grid-impact evidence, community permissions and an allocation of grid-upgrade costs. The practical constraint is increasingly the permit-and-power package, rather than announced facility capacity.
Capital markets are demanding proof that AI infrastructure contracts convert into cash flow
CoreWeave’s debt and lease obligations have become a focal point of investor concern. The company and an investor cited committed customer obligations as support for its financing model, while critics questioned whether customers would ultimately honor commitments if demand weakens or delivery is disrupted. Market reporting also described a sharp increase in the company’s credit-default-swap spreads. This does not establish an inability to pay; it shows investors assigning more risk to the financing structure. At the same time, TSMC reported strong demand for advanced manufacturing capacity and said customer demand exceeds current supply capability.
The requirement for AI infrastructure operators is not simply to secure capacity or backlog. Lenders, customers and investors will ask whether delivery schedules, power availability, customer concentration, force-majeure terms and refinancing needs are resilient under stress. Procurement leaders should assess counterparty performance obligations and exit rights alongside price and capacity commitments.
Open-weight models broaden local deployment, but hardware and licensing remain gating controls
Meta released Muse Spark Open, an open-weight multimodal model with a large parameter count and long context window. Meta and Apple said it can run across multiple high-end Mac Studio systems, while AWS made variants available through SageMaker JumpStart for deployment in a customer-controlled account. AWS describes deployment controls such as VPC attachment, encryption, network isolation, instance selection and model-version pinning; these are available implementation choices, not evidence that every deployment will use them. The model is released under Meta’s stated license and usage policy, so open weights do not mean unrestricted use.
Local or customer-account deployment can improve control over code and prompts, but it does not remove governance duties. The accountable enterprise must review the applicable license, establish access and data boundaries, control tool permissions, retain operational evidence and verify that its hardware configuration meets workload needs. “Runs locally” is an architecture option, not a compliance conclusion.
Agents are crossing from assistance into systems access—and institutions are drawing boundaries
OpenAI’s Chrome extension update can view open tabs when invoked and can control browser tabs for tasks such as messaging, form filling and downloading files. JPMorgan said it is blocking third-party agents that attempt to access customer accounts using banking credentials, while supporting customer-authorized data sharing through open-banking providers. Amazon’s newly announced Bee devices process conversation audio to generate summaries and actions; the company says raw audio is deleted after processing and transcripts are encrypted with device-created keys. These are vendor statements about product design and policy, not independent assurance that all user, bystander or enterprise risks are eliminated.
The operative control is authorization, not a broad promise that an agent is helpful or private. Enterprises should define which agents may access which applications, whether actions require human confirmation, how credentials are delegated and revoked, and what logging proves an action was authorized. Consumer-facing opt-in mechanisms do not resolve the separate obligations an employer may have toward employees, customers or other affected people.
Active exploitation makes patch evidence and incident review more important than vulnerability volume
BeyondTrust warned that a critical Remote Support authentication-bypass flaw was exploited as a zero-day, with reporting attributing the activity to a suspected China-linked actor. The reported attack chain included initial access, escalation, custom tooling, log deletion and lateral movement. CISA also added an Atlassian vulnerability to its Known Exploited Vulnerabilities catalog, and its binding directive establishes requirements for federal civilian agencies to prioritize remediation and, in specified circumstances, assess whether compromise occurred before patching. The directive applies directly to federal civilian executive-branch agencies, though CISA encourages broader adoption of risk-based remediation.
Patch completion is not sufficient evidence of safety for internet-reachable administrative systems that may have been exposed during an exploitation window. Security leaders should identify exposed instances, validate version and configuration state, preserve and review logs where available, rotate credentials that could have been brokered, and document incident-review decisions. Non-federal organizations are not subject to the directive’s scope, but the exploit-first operating model is a prudent benchmark.
